These Terms govern use of Semi-Trax truck navigation, routing, location services, traffic information, truck-related points of interest, subscriptions, accounts, and related services.
1. Acceptance of Terms
By downloading, installing, accessing, creating an account with, purchasing a subscription to, or otherwise using Semi-Trax, you agree to these Terms of Service and incorporated policies. If you do not agree, discontinue use of Semi-Trax.
2. Purpose of Semi-Trax
Semi-Trax is designed primarily to assist commercial truck drivers with navigation and trip planning. Features may include truck GPS navigation, turn-by-turn directions, voice guidance, truck-specific routing, route recalculation, multi-stop routing, vehicle profiles, restrictions, traffic, closures, truck stops, rest areas, weigh stations, parking, fuel, repair, weather, HOS assistance, and ELD integrations where supported.
3. Navigation Is an Assistance Tool
Semi-Trax does not replace the driver's professional judgment or responsibility. Official road signs, lawful instructions, DOT requirements, temporary restrictions, bridge clearances, weight limits, hazmat restrictions, weather closures, and applicable laws always control.
4. Vehicle Profile Accuracy
Users are responsible for accurately entering and maintaining vehicle height, width, length, gross vehicle weight, trailer information, number of axles, hazmat status, vehicle type, and applicable permits or restrictions.
5. Low Bridges and Restricted Roads
Map databases and restriction information can contain errors, omissions, delays, or outdated information. Drivers must visually verify bridge clearances and road restrictions before proceeding.
6. Weigh Stations
Semi-Trax may display weigh-station locations and status information. Status can change rapidly. Semi-Trax does not authorize a driver to bypass a required weigh station.
7. Truck Parking
Parking availability is not guaranteed. Users remain responsible for selecting safe and legal parking locations.
8. Fuel Prices
Fuel prices may come from third-party providers and may change before arrival. The price displayed at the physical location controls.
9. Traffic and Road Conditions
Traffic conditions, incidents, closures, construction, weather, and estimated travel times can change rapidly and are not guaranteed to be complete or current.
10. Safe Use and Distracted Driving
Safety must always take priority over interaction with the application. Configure navigation before driving whenever possible and comply with all distracted-driving and mobile-device laws.
11. Accounts and Prohibited Activity
Users are responsible for account security. Fraud, unauthorized access, system manipulation, malware, unauthorized scraping, unlawful use, and attempts to bypass subscription or security restrictions are prohibited.
12. Subscriptions, Billing, Cancellation and Refunds
Semi-Trax may offer free and paid services. Automatically renewing subscriptions may renew until canceled. Prices may change with notice where required. Cancellation and refunds may be governed by the applicable app store, payment provider, law, and Semi-Trax terms.
13. Third-Party Services
Semi-Trax may rely on mapping, navigation, traffic, government, ELD, cloud, payment, and other third-party services. Semi-Trax cannot guarantee their continuous availability, completeness, or accuracy.
14. Intellectual Property
Except for third-party materials, Semi-Trax software, branding, designs, databases, interfaces, graphics, and original content are protected by applicable intellectual-property laws. Users receive only a limited, revocable, non-exclusive, non-transferable license to use the service for its intended purpose.
15. Service Availability and Updates
Features may depend on GPS, internet connectivity, mobile networks, device hardware, third-party APIs, mapping providers, and government data feeds. Semi-Trax may release updates for security, compatibility, navigation data, functionality, or performance.
16. No Guarantee of Error-Free Navigation
Semi-Trax cannot guarantee every route, restriction, clearance, closure, traffic condition, parking location, fuel price, or point of interest will always be correct. Users must exercise independent judgment.
17. Commercial Vehicle Responsibility
The driver and, where applicable, the motor carrier remain responsible for determining whether a commercial vehicle may legally and safely travel on a particular road.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Semi-Trax and its owners, affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages resulting from use of or inability to use the service. Nothing excludes liability that cannot legally be excluded.
19. No Warranty
To the maximum extent permitted by law, Semi-Trax is provided on an “as is” and “as available” basis. Consumer rights that cannot legally be waived remain unaffected.
20. Suspension, Termination and Policy Changes
Semi-Trax may suspend or terminate access for fraud, security threats, illegal activity, abuse, serious or repeated violations, unauthorized access, or attempts to compromise systems. Policies may be updated as services, laws, and technologies change.
21. Disputes
Users and Semi-Trax are encouraged to attempt to resolve disputes through customer support before formal proceedings. Any mandatory arbitration, class-action waiver, venue requirement, or similar provision should be reviewed by qualified legal counsel before publication.
