IMPORTANT NOTICE
Semi-Trax is intended to assist commercial drivers with navigation and trip planning. It does not replace professional judgment, posted road signs, law-enforcement instructions, DOT requirements, or applicable laws and regulations.
1. Acceptance of Terms
By downloading, installing, accessing, creating an account with, purchasing a subscription to, or otherwise using Semi-Trax, you agree to these Terms of Service, Privacy Policy, Safety Policy, Subscription and Cancellation Policy, and other policies incorporated into these terms. If you do not agree, you must discontinue use of Semi-Trax.
PART I — SEMI-TRAX SERVICES
2. Purpose of Semi-Trax
Semi-Trax is designed primarily to assist commercial truck drivers with navigation and trip planning. Depending on availability, location, device, subscription level, and third-party services, features may include commercial-truck GPS navigation, turn-by-turn directions, voice guidance, truck-specific routing, route recalculation, multiple-stop routing, vehicle profiles, height/weight/width/length/axle restrictions, hazmat routing, low-clearance warnings, bridge and tunnel information, road restrictions, traffic, closures, construction, truck stops, rest areas, weigh stations, parking, fuel, repair facilities, truck washes, restaurants, hotels, stores, cameras, weather, hours-of-service assistance, ELD integrations, and other trucking/navigation services.
3. Navigation Is an Assistance Tool
Semi-Trax does not replace the driver's professional judgment or responsibility. Official road signs, traffic signals, police/DOT instructions, temporary restrictions, construction signs, bridge clearances, weight limits, hazmat restrictions, weather closures, emergency instructions, and applicable laws always control.
4. Vehicle Profile Accuracy
Users are responsible for accurately entering and maintaining vehicle height, width, length, gross vehicle weight, trailer information, number of axles, hazmat status, vehicle type, and permits/restrictions.
5. Low Bridges and Restricted Roads
Map databases and restriction information may contain errors, omissions, delays, or outdated information. Drivers must visually verify bridge clearances and road restrictions before proceeding.
6. Weigh Stations
Semi-Trax may display weigh-station locations and statuses such as Open, Closed, Inspection, or Unknown. Status can change rapidly. Semi-Trax does not authorize bypassing a required weigh station.
7. Truck Parking
Parking locations and availability may be estimated or reported and are not guaranteed. Users remain responsible for safe and legal parking.
8. Fuel Prices
Displayed fuel prices may come from third-party providers and can change. The price displayed at the physical location controls.
9. Traffic and Road Conditions
Traffic, incidents, closures, construction, weather, and estimated travel times can change rapidly and are not guaranteed to be complete or current.
PART II — DRIVER SAFETY
10. Safe Use While Driving
Safety must always take priority over interaction with the application. Configure destination, truck profile, route preferences, stops, and settings before driving whenever possible.
11. Distracted Driving
Comply with all applicable distracted-driving and mobile-device laws. Do not type, browse menus, watch video, or perform distracting interactions while operating a vehicle. Safely park before manual interaction when necessary.
12. Emergency Situations
Semi-Trax is not an emergency-response service. Contact appropriate emergency services or authorities in an emergency.
PART III — ACCOUNTS
13. User Accounts
Users are responsible for accurate information, account security, passwords/authentication credentials, preventing unauthorized access, and keeping contact information current.
14. Prohibited Account Activity
Users may not impersonate others, create fraudulent accounts, sell unauthorized access, bypass subscription restrictions, manipulate systems, interfere with security, introduce malware, scrape protected data without authorization, reverse engineer except where law permits, or use Semi-Trax unlawfully.
PART IV — SUBSCRIPTIONS AND PAYMENTS
15. Paid Services
Semi-Trax may offer free and paid services. Current prices and included features will be displayed before purchase.
16. Subscription Billing
Automatically renewing subscriptions may renew at the applicable billing interval until canceled.
17. Price Changes
Semi-Trax may change subscription pricing and will provide notice where required.
18. Cancellation
Recurring subscriptions may be canceled through the purchase method, app store, payment provider, or Semi-Trax account-management system.
19. Refunds
Refund eligibility depends on applicable law and relevant app-store/payment-provider policies.
PART V — PRIVACY POLICY
20. Information Semi-Trax May Collect
Depending on use, Semi-Trax may collect account, device, location, vehicle, and usage information.
21. Why Information Is Used
Information may be used for navigation, routing/rerouting, nearby services, traffic, accounts, subscriptions, security, diagnostics, performance improvements, support, fraud prevention, and legal obligations.
22. Location Permissions
Navigation requires device location. Disabling location permissions may prevent location-dependent features.
23. Background Location
Where used, background location supports disclosed functionality such as maintaining active navigation while the app is not foregrounded.
24. Selling Personal Information
Semi-Trax does not sell personal information merely because a user uses navigation services. Applicable disclosures and legally required choices will be provided if practices change.
25. Service Providers
Semi-Trax may use third parties for mapping, navigation, traffic, location, cloud hosting, authentication, analytics, crash reporting, payments, support, fuel, parking, and government transportation data.
26. Mapping Providers
Semi-Trax may use maps, routing, traffic, location, navigation, or other data from HERE Technologies or other mapping providers. Third-party terms, licenses, notices, and privacy requirements may apply.
27. Government and 511 Data
Government transportation information may be delayed, unavailable, incomplete, or changed by the originating agency.
28. ELD Integrations
ELD integration availability and accuracy depend on third-party providers and do not replace driver/carrier HOS or ELD compliance responsibilities.
29. Data Retention
Information may be retained as reasonably necessary to provide services, maintain accounts, resolve disputes, prevent fraud, maintain security, and comply with law.
30. Data Security
Semi-Trax uses reasonable administrative, technical, and organizational safeguards, but no internet service or electronic storage system can guarantee absolute security.
31. User Privacy Rights
Depending on jurisdiction, users may have rights to access, correct, delete, obtain copies of information, receive data-practice information, or withdraw certain permissions.
32. Account Deletion
Eligible users will have a method to request account deletion. Certain records may be retained for legal, security, fraud-prevention, accounting, or regulatory reasons.
PART VI — THIRD-PARTY SERVICES
33. Third-Party Information
Semi-Trax cannot guarantee continuous availability, completeness, or accuracy of third-party services.
34. External Businesses
Displaying a business does not necessarily constitute endorsement. Users should independently evaluate businesses.
PART VII — USER CONTRIBUTIONS
35. User Reports
Users may be permitted to report parking, road conditions, weigh-station observations, closures, hazards, and corrections. Reports must be honest and in good faith.
36. Content License
For voluntarily submitted content intended for Semi-Trax display/use, users grant rights reasonably necessary to host, process, reproduce, and display that content to operate and improve the applicable feature, subject to law and privacy policies.
PART VIII — INTELLECTUAL PROPERTY
37. Semi-Trax Property
Except for third-party materials, Semi-Trax software, branding, designs, databases, interfaces, graphics, and original content are protected by applicable intellectual-property laws.
38. Limited License
Users receive a limited, revocable, non-exclusive, non-transferable license to use the application for its intended purpose subject to these terms.
PART IX — SERVICE AVAILABILITY
39. Internet and GPS Dependency
Features may depend on GPS, internet connectivity, mobile networks, device hardware, third-party APIs, mapping providers, and government feeds.
40. Updates
Semi-Trax may release updates for security, compatibility, navigation data, functionality, or performance.
PART X — DISCLAIMER AND LIABILITY
41. No Guarantee of Error-Free Navigation
Semi-Trax cannot guarantee every route, restriction, clearance, closure, traffic condition, parking location, fuel price, or point of interest will always be correct.
42. Commercial Vehicle Responsibility
Drivers and carriers remain responsible for determining whether a commercial vehicle may legally and safely travel on a particular road.
43. Limitation of Liability
To the maximum extent permitted by law, Semi-Trax and its owners, affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages resulting from use of or inability to use the service, including where permitted lost profits, lost loads, missed appointments, delivery delays, towing expenses, vehicle damage, cargo losses, business interruption, or loss of data.
44. No Warranty
To the maximum extent permitted by law, Semi-Trax is provided on an “as is” and “as available” basis. Rights that cannot legally be waived remain unaffected.
PART XI — ENFORCEMENT
45. Suspension and Termination
Semi-Trax may suspend or terminate access for fraud, security threats, illegal activity, abuse, serious/repeated violations, unauthorized access, or attempts to compromise systems.
46. Changes to These Policies
Semi-Trax may update these policies as the application, laws, technologies, or services change. Material-change notice will be provided where legally required.
PART XII — GOVERNING LAW AND DISPUTES
47. Governing Law
The final published version should identify the governing law of the Semi-Trax operating company, subject to mandatory consumer-protection laws.
48. Dispute Resolution
Users and Semi-Trax are encouraged to attempt to resolve disputes through customer support before formal proceedings. Any arbitration, class-action waiver, venue requirement, or mandatory dispute mechanism should be reviewed by qualified legal counsel before publication.

IMPORTANT DRIVER SAFETY NOTICE
Semi-Trax is an assistance tool, not a substitute for professional driving judgment. Always obey official road signs, law-enforcement instructions, DOT requirements, bridge clearances, weight restrictions, hazmat restrictions, and applicable laws. Never follow Semi-Trax directions when doing so appears unsafe, illegal, or inconsistent with posted road restrictions. When there is a conflict between Semi-Trax and an official road sign or lawful instruction, follow the official sign or instruction.
